The present writ petition is filed under Article 226 of the Constitution of India and section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing by consent, of the C.R. No.1566 of 2024 with the Hadapsar Police Station along with charge-sheet filed before the J.M.F.C Cantonment vide R.C.C. No.528 of 2025.

The petitioner is present in the Court and is identified by his learned advocate. The respondent no.2 is present through virtual mode and is identified by Mr. Asare, the learned advocate appearing on her behalf. Both the parties have tendered the details of their aadhar card, which is endorsed by their respective 1/2 80-WP-5219-2025.doc Dixit
advocates. The same is taken on record and shall be part of the present proceedings. A copy of the consent affidavit of the respondent no.2 dated 3rd November, 2025 is annexed at page 85 of the petition. The respondent no.2 has stated that she does not wish to take criminal action against the petitioner in view of settlement of differences between the parties. The consent affidavit of the respondent no.2 records the settlement and agreement to quash the current proceedings.

The law as laid down in "Narinder Singh v. State of Punjab" (2014) 6 SCC 466 reiterates that the Court is empowered to quash the criminal proceedings to meet the ends of justice, especially wherein the complainant no longer wishes to proceed with the prosecution. In view of the above, Writ Petition No.5219 of 2025 is allowed in terms of prayer clause (a), which reads as under: "(a). That, this Hon'ble Court be pleased to pass appropriate writ, order and direction directing the quashing of FIR No.1566 of 2024 dated 09.10.2024 registered under the provisions of section 69 of BNS with the Hadapsar Police Station, Pune on such terms as this Hon'ble Court may deem fit and proper."
