This is a Petition for quashing of the proceedings arising out of C.R. No.60/2025 registered at Bhor police station, Pune Rural under Sections 498-A, 313, 324, 323, 504, 506, 342, 143, 147, 148 and 149 of the IPC as well as the chargesheet bearing R.C.C. No.161/2025 (earlier R.C.C. No.545/2025) pending before the learned J.M.F.C, Bhor, Pune. 2.

The Petition is for quashing of these proceedings by consent. The FIR is lodged by the Respondent No.2. The Petitioner No.1 is her husband and all other Petitioners are the close relatives of her husband. It is not necessary to refer to the allegations in detail because the parties have not only settled the matter, but, the Petitioner No.1 and the Respondent No.2 are staying together. The FIR is lodged and the chargesheet is filed for the offences punishable under Sections 498-A, 313, 324, 323, 504, 506, 342, 143, 147, 148 and 149 of IPC. 4.

Briefly stated, the allegations are that the Respondent No.2 - informant got married with the Petitioner No.1 on 21.5.2023. She started residing with her husband and his parents. The brothers of the husband were residing with their family in different buildings. They used to visit her matrimonial house. The FIR thereafter goes on to mention the different instances in which she was ill-treated. The Petitioner No.1 was not happy because of her use of mobile phone. There

are allegations that he used to beat her and used to lock her in the bed-room. He used to chat with his female friends. There is a reference that when she had become pregnant in November, 2024 she was made to consume pills. There was a reference to one instance dated 15.4.2025 when the informant's relatives had gone to the house of the Petitioners to find a solution but there was some quarrel and some fight. Based on these allegations, the FIR is lodged. 5.

For the same incident dated 15.4.2025, the Petitioner No.1 had lodged his own FIR. Those proceedings are quashed by a separate order passed today in Criminal Writ Petition No.5246/2025. The charge-sheet contains statements of father, uncle, cousins and other family members of the informant. After all this dispute and quarrel, now the matter is settled between the parties. The Respondent No.2 has filed her affidavit-in-reply before the court. She has clearly stated that she has no objection for quashing of these proceedings and in fact they had decided to stay together. She is present in the Court. She is identified by her learned counsel. She reiterated

the contents of the affidavit. She stated before the Court that she has no objection for quashing of these proceedings and they are staying together.

Considering this situation and in the interest of justice as well as in the interest of both the parties, we are inclined to allow this Petition. No purpose would be served in continuation of the criminal prosecution.

Hence, the following order:

i.

The FIR being C.R. No.60/2025 registered at Bhor police station, Pune Rural as well as the consequent criminal prosecution being R.C.C. No.161/2025 (earlier R.C.C. No.545/2025), pending before the learned J.M.F.C, Bhor, Pune, are quashed and set aside.

ii.

The Petition is disposed of accordingly.
