The present Criminal Writ Petition No.5272 is filed under Article 226 of the Constitution of India and section 528 of Bhartiya Nagarik Suraksha Sanhita, 2023 seeking the following reliefs:- "(b) The C.R. No.0281 of 2024 dated 23/08/2024 registered by Kharghar Police Station for the commission of offence under sections 323, 498-A, 504 and 506 of the Indian Penal Code may be quashed and set aside;
(c) The charge-sheet filed by Kharghar Police Station in C.R. No.0281 of 2024 dated 23/08/2024 for the commission of offence under sections 323, 498-A, 504 and 506 of the Indian Penal Code may be quashed and set aside;
(d) The complaint bearing R.C.C. No.218 of 2025 pending before the 1st Court, ld. J.M.F.C. Panvel arising out of C.R. No.0281 of 2024 dated 23/08/2024 of Kharghar Police Station may be quashed and set aside."

The marriage between the petitioner no.1 and the respondent no.2 was solemnized 5th June, 2023 as per the Hindu rites and rituals. The petitioner nos.2 and 3 are the parents of petitioner no.1. Owing to marital discord, disputes arose between the parties. On 23rd August, 2024, a First Information Report bearing C.R. No.281 of 2024 was lodged at the instance of the respondent no.2 at Kharghar police station alleging harassment and cruelty. Pursuant thereto, a charge-sheet came to be filed in the criminal proceedings registered as R.C.C. No.218 of 2025 before the 1st Court of learned Judicial Magistrate First Class, Panvel. The petitioners preferred an anticipatory bail application bearing number ABA/704/2021 before the Sessions Court at Panvel and the same was allowed on 10th October, 2024. 3.
The parties have now arrived at an amicable settlement. The petitioner no.1 and the respondent no.2 have executed consent terms before the learned Family Court, Belapur in F-Petition No.323/2025, wherein it is recorded that all disputes stand settled. The respondent no.2 has filed a consent affidavit dated 4 th December 2025 stating that she has no objection to the quashing of the criminal proceedings in view of the settlement arrived at between the parties. The petitioner no.1 and the respondent no.2 are present before the Court through video conferencing. The petitioner no.3 has expired and a death certificate in support thereof is tendered and taken on record. All parties are duly identified by their respective learned counsel. The learned counsel for the parties have endorsed the Aadhaar details of their respective clients and recorded their appearance, which shall form part of the record. The present petition seeking quashing of the FIR and all consequential proceedings is allowed solely on the 2/3
basis of the undertakings given by the petitioners under the aforesaid consent terms.

The Hon'ble Supreme Court in "B.S. Joshi v. State of Haryana" (2003) 4 SCC 675 has held that the High Court may exercise its inherent jurisdiction to quash criminal proceedings arising out of matrimonial disputes where the Court is satisfied that the parties have arrived at an amicable settlement and that such exercise would secure the ends of justice. In the present case, the parties have settled their disputes and have executed consent terms before the Family Court. In view thereof, continuation of the criminal proceedings would serve no fruitful purpose. Accordingly, Criminal Writ Petition No.5272 of 2025 is allowed in terms of the prayers quoted above.
