2) Perusal of the impugned Notice dated 25th August 2025 clearly reveals that, the Sub-Divisional Police Officer, Niphad Division has called upon the Petitioners to appear before it on 8th September 2025 for hearing of the said case. The Petitioners are further granted liberty to file their say/reply to the said proceeding initiated under section 164 of the BNSS. Thus, the Petitioners are having a alternate remedy available at their disposal even as per the impugned Notice.

Learned Advocate for the Petitioners on instructions submitted 1/2

In view thereof, learned Advocate for the Petitioners on instructions seeks leave to withdraw Petition with liberty to file reply to the said Criminal Case No.244/2025 and appear before Respondent No.1 at the time of hearing of the said case.
