The petitioner prays for the following relief: - "a) That this Hon'ble Court may pass appropriate orders to issue appropriate writs/orders/directions and quash and set aside FIR No. 255 of 2025 registered with Kandivali Police Station and all other proceedings, including Charge Sheets if any filed, arising out of and from the said FIR registered with Kandivali Police Station, Mumbai and/or pending before the Hon'ble Ld. JMFC, 17th Court, Borivali." 2.

Mr. K. V. Saste, the learned Additional Public Prosecutor has drawn attention of the Court to the order dated 16th June 2025 at running page 15 of the paper book vide Exhibit-B by which cognizance of the offences under section 118(1), 115(2) and 324(4) of the Bhartiya Nyaya Sanhita, 2023 has been taken by the Court of Judicial Magistrate, 17th Court, Borivali, Mumbai. 3.

In view thereof and considering Rule 2 (II) (h) under Chapter I of the Bombay High Court Appellate Side Rules, 1960, the learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file fresh petition/application, if so advised. 4.

Writ Petition No. 5560 of 2025 is dismissed as withdrawn with the aforesaid liberty.
