Heard the learned counsel for the petitioner. 2.

The petitioner is aggrieved by the order dated 6th December 2024 passed by the learned Additional Sessions Judge in Appeals Nos. 385/2017 and 386/2017 whereby on account of the absence of the petitioner/appellant the learned Additional Sessions Judge has directed the issue of non-bailable warrant and also forfeited the bail bonds.

The learned counsel for the petitioner submits that on the next

Varsha 15-16-wp-5639-2025-5640-2025.doc scheduled date i.e. 21st November 2025, the petitioner/appellant would appear before the learned Additional Sessions Judge and seeks cancellation of NBW and recall of the order dated 6th December 2024. 4.

Let the petitioner appear before the learned Additional Sessions Judge on 21st November 2025 and file an application for cancellation of the non-bailable warrant and recall of the order of forfeiture of the bail bonds.

In the event such an application is filed, the learned Additional Sessions Judge is requested to decide the said application on its own merits and in accordance with law.

In the meanwhile, to facilitate the petitioner to appear before the learned Additional Sessions Judge, the execution, operation and implementation of the non-bailable warrant issued against the petitioner shall remain stayed till 21st November 2025. 7.

It is hereby made clear that all contentions are kept open for consideration, and in the event of default on the the part of the petitioner to appear before the learned Sessions Judge on 21st November 2025, the interim protection granted by this Court shall come to an end automatically.
