The petitioner pray for the following relief: - "a) That this Hon'ble Court be pleased to issue appropriate order thereby to quash and set aside FIR No. 495 of 2023 dated 06.07.2023 registered under Sections 384 and 385 of the Indian Penal Code, with Shirur Police Statiion, Pune, along with chargesheet No. 91 of 2025 dated 25.03.2025 filed in Regular Criminal Case No. 449 of 2025 as well as Regular Criminal Case No. 449 of 2025 pending on the file of Ld. Third Joint Civil Judge Junior Division and Judicial Magistrate First Class, Ghodnadi, Tal. Shirur Dist. Pune against the Petitioner being abuse of process of law and for ends of justice."

The learned Additional Public Prosecutor states that the Court concerned has taken cognizance of the offence on 23rd June 2025. 3.

The learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to challenge the order taking cognizance or any other further order passed by the Court concerned.

Writ Petition No. 5808 of 2025 is dismissed as withdrawn with the aforesaid liberty.

The Registry shall provide a photocopy of page no. 13 of the paper book to the Principal District and Sessions Judge, Pune and seek a report from him as to how the learned Magistrate has taken cognizance of the offence through a rubber stamp.
