The petitioner has filed this writ petition seeking quashing of First Information Report No.247 of 2009 lodged on 8th August 2009 with Kandivali Police Station.

Mrs. M. M. Deshmukh, the learned In-charge Public Prosecutor for respondent no.1-State submits that the cognizance of the offence is taken on 24th December 2010.

In view of the above, Mr. Samir A. Vaidya, the learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to avail of the remedy that may be available in law before the learned single Judge.
