The petitioner has filed this writ petition seeking quashing of First Information Report No.291 of 2007 lodged on 19th April 2007 with Goregaon Police Station.

Ms. Mahalaxmi Ganapathy, the learned Additional Public Prosecutor for respondent no.1-State submits that the cognizance of the offence is taken.

In view of the above, Mr. Samir A. Vaidya, the learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to avail of the remedy that may be available in law before the learned single Judge.
