By the present Petition filed under Article 226 of the Constitution of India and Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS'), the Petitioner has sought the following substantive relief :- "a) That, this Hon'ble Court be Quash and set aside FIR No. 316 of 2025 registered with in Rajgad Police Station, Pune for offences punishable U/Sec. Under Sections 333, 74, 351 (2), 351(3), of BNS 2023." 2.
Mr. Sukanta Karmarkar, learned APP for the State, submits that during the pendency of this Petition, the prosecution has filed charge-sheet in FIR No. 316 of 2025, before the Court Gayatri Shimpi

In view of the statement made by the learned APP, Ms. Heena Sheikh, learned Advocate for the Petitioner, on instructions from the Petitioner, seeks leave to withdraw this Petition with liberty to file a composite Petition challenging the FIR as well as the charge-sheet. Request made by Ms. Heena Sheikh, learned Advocate for the Petitioner, is not objected to by Mr. Sukanta Karmarkar, learned APP for the State.

In view of the above, leave granted to withdraw the present Petition with liberty to file a fresh Petition challenging the FIR impugned in this present Petition as well as the charge-sheet filed in Crime No.316 of 2025 registered with Rajgad Police Station, Pune. All contentions of the Petitioners raised in this Petition are left open.

Writ Petition No.6230 of 2025 is disposed of as withdrawn with the liberty as above.
