This Petition is filed by the husband of the Respondent No.1 mainly for production of their two children aged 6 and 4 years respectively before this Court. The second prayer is for visitation/access rights to the Petitioner during pendency of the Petition. And the third prayer is for protection during visitation MANUSHREE NESARIKAR right.

At the outset, when we expressed our opinion that in the facts of the case the writ of Habeas Corpus may not be a proper remedy, learned counsel for the Petitioner submits that she be permitted to prefer appropriate proceedings before the appropriate Court for custody and/or access of the children. She submitted that she be permitted to withdraw this Petition with such liberty.

Permission is granted. The Petition is allowed to be withdrawn with such liberty to the Petitioner to approach appropriate forum for custody/access of the children. 4.

The Petition is disposed of.
