DATED : 26 March 2026 PC:- 1.
Mr. Ashwin Thool, learned Special Counsel for the Respondent No.2 raises a preliminary objection to the maintainability as well as entertainability of the present Petition. His objection is of two fold; first that the Petition challenges an order dated 20 October 2025 passed by the Judicial Magistrate First Class, Daman in Bail Application No.177 of 2025 which is no more in force or in existence and at any rate which order has worked itself out. Second, he
(26) WP-6286.25.DOCX submits that the relief sought for in the present Application is apparently a relief which is requests for grant of bail. To sum up, he submits that this Petition is rendered infructuous in view of the several other orders passed in the proceedings which orders have attend finality for not being challenged within the period prescribed.
2.
Faced with the said objection raised by Mr. Ashwin Thool, learned Special Counsel for the Respondent No.2, Mr. Majeed Memon, learned Senior Advocate for the Petitioners, requests for time till 30 April 2026.
3.
Request for time made by Mr. Majeed Memon, learned Senior Advocate for the Petitioners is not objected to by Mr. Ashwin Thool, learned Special Counsel for the Respondent No.2 4.
At the request of Mr. Majeed Memon, list this matter on 30 April 2026.
