Heard the learned Counsel for the parties.

The challenge in this petition is to an order dated 14th October, 2025 passed by the learned Special Judge, Thane. 3.

The learned Counsel for the petitioner submits that the petitioner had not appeared only on 14th October, 2025, and the learned Special Judge was persuaded to issue non-bailable warrant. The learned Counsel for the petitioner submits that on the next scheduled date of the Special Case i.e. 29th January, 2026 , the petitioner will appear before the learned Special Judge.

The roznama of the proceedings indicates that the petitioner had appeared before the learned Special Judge on the date preceding the day on which non-bailable warrant came to be issued.

In the aforesaid circumstances, this Court considers it appropriate to grant liberty to the petitioner to appear before the learned Special Judge on the next scheduled date of listing of the Special Case and, in the meanwhile, grant interim protection.

The petition, thus, stands disposed with liberty to the petitioner to appear before the learned Special Judge on 29th January, 2026 and file an application for cancellation of nonbailable warrant. 7.

In the event the petitioner appears and files such application before the learned Special Judge on 29th January, 2026, the learned Special Judge may have due regard to the fact that the petitioner has appeared before the Court and undertakes to regularly appear before the Court thenceforth. 8.

In the meanwhile, the execution and operation of the nonbailable warrant shall be remain stayed till 29th January, 2026. [N. J. JAMADAR, J.] 2/2
