Heard the learned Counsel for the petitioner. 2.
The challenge in these petitions is to an order dated 4th November, 2025, whereby the applications preferred by the petitioner to initiate action under Section 340 of the Code of Criminal Procedure, 1973, were rejected by the learned Additional Sessions Judge by imposing costs of Rs.5,000/-. 3.
When the Court expressed its disinclination to entertain the petitions, the learned Counsel for the petitioner submitted that the petitioner be relieved of the liability to pay the costs. 4.
Having regard to the fact that the petitioner appeared to have filed the applications for initiation of action under Section 1/2
42&45-WP6407-2025+.DOC 340 of the Code of Criminal Procedure, under an incorrect yet bona fide impression about the conduct attributed to the respondents, the prayer for relieving the petitioner from the liability to pay the costs appears justifiable. 5.
