The learned Counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to file an application under Section Section 358 of the Bhartiya Nagarik Suraksha Sanhita, 2023 (Section 319 of the Code of Criminal Procedure, 1973) after complainant leads evidence. Leave granted with liberty as prayed for.

In the event such an application under Section 358 of the Bhartiya Nagarik Suraksha Sanhita, 2023 is filed, the learned Magistrate shall decide the same on its own merits and in accordance with law.

The petition stands dismissed as withdrawn.
