The present Criminal Writ Petition is filed under Article 226 of the Constitution of India and section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 seeking quashing of the FIR No.620 of 2024 dated 5th December 2024 registered with Kalyan Taluka Police Station alongwith proceedings in

Chargesheet pending before Sessions Court Kalyan vide Session Case No.134/2025, under sections 64(2)(M), 115(2), 352, 351(2) of B.N.S. registered with Kalyan Taluka Police Station, Titwala in its entirety.

The present dispute arises out of the relationship between the petitioner and the respondent no.2. Differences arose between the parties which led to the filing of the present FIR against the petitioner. The investigating officer thereafter filed chargesheet in Sessions Case No. 134/2025 before the learned Sessions Court, Kalyan. The petitioner was arrested on 5th December, 2024 and released on bail by order dated 3rd March 2025 in Bail Application No.383/2025. 3.

The parties have now amicably settled the disputes amongst them. Ms. Mahto, learned counsel for the respondent no.2 tenders an affidavit dated 21st November 2025 which records consent of the respondent no.2 to quash the present FIR and all proceedings arising therefrom. The parties are present in the Court and identified by their respective counsel. The parties have affixed their signatures and recorded their appearance in their own handwriting and have tendered self-attested copies of Aadhar Card which shall form part of the proceedings.

The Hon'ble Supreme Court in "Madhukar v. State of Maharashtra, 2025 SCC OnLine SC 1415 held that the High Court can invoke its inherent power to quash criminal cases arising from disputes wherein the complainant no longer wishes to pursue the complaint, provided the court is satisfied that an amicable settlement has been reached.

Hence, Criminal Writ Petition No.6646 of 2025 is allowed in terms of prayer clause (a) and the FIR bearing No. 620 of 2024 dated 5th December, 2024 along with chargesheet in Sessions Case No. 134 of 2025 and all the consequential proceedings arising therefrom stand quashed and set aside.
