Heard the learned Counsel for the parties.

The challenge in this Petition is to an order dated 1st December 2025 passed by the learned Judicial Magistrate, First Class, Dadar, ARUN RAMCHANDRA SANKPAL Mumbai, whereby while releasing the Petitioners on bail, the learned by ARUN RAMCHANDRA SANKPAL Date: 2025.12.22 09:57:00 +0530 Magistrate has directed the Petitioners to furnish bank guarantee of varying amounts within a period of one month from the date of the said order.

The aforesaid direction is in teeth of the judgment of the Supreme Court in the case of Gajanan Dattatray Gore Vs State of Maharashtra & Anr.1 4.
Issue notice to the Respondents returnable on 8th January 2026. 5.
Mr. K.C. Shinde, the learned APP, waives service of notice for Respondent No.1.

Mr. Inderpal Singh, the learned Advocate submits that he has instructions to appear on behalf of Respondent No.2 and undertakes to file vakalatnama within a period of one week. 7.
Stand over to 8th January 2026.

In the meanwhile, the condition to furnish bank guarantee stands stayed.
