The present Criminal Writ Petition is filed under Article 226 of the Constitution of India and section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 seeking quashing of the FIR No.1106 of 2025 dated 23rd October 2025 registered with Santacruz Police Station.

The present dispute arises out of the relationship

BDP 9 crwp-6723-25.doc between the petitioner and the respondent no.2. Differences arose between the parties which led to the filing of the present FIR against the petitioner. The parties have now amicably settled the disputes and decided to put a quietus to the differences between them.

The respondent no.2 has tendered an affidavit dated 12th December 2025 which records that the respondent no.2 has no objection to the quashing of the criminal proceedings in view of the settlement reached between the parties. The learned counsels for the parties have tendered a copy of the Aadhaar Cards of their respective client and the same shall be part of the record.

The Hon'ble Supreme Court in "Madhukar v. State of Maharashtra", 2025 SCC OnLine SC 1415 held that the High Court can invoke its inherent power to quash criminal cases arising from disputes wherein the complainant does not wish to pursue any further proceedings, provided the court is satisfied that an amicable settlement has been reached. The parties have settled their dispute and an affidavit has been tendered to that effect. Hence, Criminal Writ Petition No. 6723 of 2025 is allowed in terms of prayer clause (a) which reads as under:- "(a) That this Hon'ble Court be pleased to quash and set aside the FIR bearing No.1106 of 2025 dated 23.10.2025 registered with Santacruz Police Station u/s. 69, 74 & 89 of BNS at the instance of Respondent No.2 against the petitioner on such terms and conditions as this Hon'ble Court may deem fit and proper;"
