By the present Petition filed under Article 226 and under Section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 Petitioner has sought for the following relief : "b) This Hon'ble Court be pleased to quash and set aside the FIR No. 114/2025 dated 19/05/2025 registered with Pawarwadi Police Station and all the proceedings arising therefrom against the petitioner." 2.
Mr. Prasanna Malshe, learned APP for the State on
instructions states that charge sheet has been filed in the present crime. Mr. Abhishek Mishra, learned Advocate for the Petitioner after having argued the matter for sometime sought pass over. At his request, matter was taken after sometime. 3.
Mr. Abhishek Mishra, learned Advocate for the Petitioner on instructions from the Petitioner submits that as charge sheet has been filed in the present crime, he on instructions from the Petitioner craves leave to withdraw the present Petition with liberty to file application seeking discharge before the Trial Court at the appropriate stage.

Mr. Prasanna Malshe, learned APP for the state does not object to the request made by the learned Advocate for the Petitioner.

In view of the above, leave granted to withdraw the present Petition with liberty as prayed for. If any such application is filed before the Trial Court, the same may be considered on its own merits and in accordance with law.

Criminal Writ Petition No. 6789 of 2025 is disposed of as withdrawn with the liberty as above.
