This matter was substantially heard on 26th December 2025 and was adjourned at the request of Mr. Marmik Shah learned Advocate for the Petitioner.

Today, Mr. Marmik Shah, learned Advocate for the Petitioner, on instructions from the Petitioner submits that the Petitioner will file an appropriate application before the Civil Court in the pending proceedings bearing Suit No. 1974 of 2022, seeking injunction against the Defendants in the said Suit. He, therefore, on instructions from the Petitioner craves leave to withdraw the present Petition. 3.

Mr. Vinit Kulkarni, the learned APP does not object to the request made by Mr. Marmik Shah.

In view of the above, leave granted to withdraw the present Writ Petition with liberty to file an appropriate application before the Civil Court.

Mr. Marmik Shah submits that such an application will be filed by the Petitioner before the Civil Court in Suit No. 1974 of 2022, within a period of one week from today. He therefore requests for a direction to the Civil Court to dispose of the same within a stipulated time. If such an application is filed by the Petitioner before the Civil Court within a period of one week from today, then Civil Court to decide the same on its own merit and in accordance with law. Civil Court to make an endeavour to decide the same expeditiously . 6.

Criminal Writ Petition No. 6812 of 2025 is disposed as withdrawn.
