By the present Petition, the Petitioner has sought for the following substantive relief :

"a.

That FIR been C.R. No. 168 of 2023 registered with Tilak Nagar Police Station, Mumbai for offences under punishable under Sections 498A, 323, 504, 506 of the Indian Penal Code, 1860; and the proceedings arising out of it been Case No. 1799/PW/2023 pending in Metropolitan Magistrate Court, 34th Court, Vikhroli, Mumbai.be quashed and set aside;"

Petitioner is present alongwith his Advocate Ms. Sadaf Khan. 3.

Respondent No. 2 (Advocate Ms. Nazma @ Sanika Dinesh Bhoir) is present in person. Respondent No. 2 tenders affidavit dated 6th January, 2026 affirmed before the Notary S.N. Dhange, same is taken on record and marked "X" for identification. She states that she is filing the affidavit ("X") out of her own free will and without any pressure from any one. She states that the contents of the affidavit are as per her say. She states that the matrimonial dispute between her and the Petitioner is resolved in Petition No. 935 of 2023 before the Family Court, Bandra, Mumbai, as such she has no objection for quashing of the FIR and the charge-sheet registered on the basis of her complaint. 4.

Petitioner sates that he and the Respondent No.2 have amicably settled their dispute.

Mr. Sukanta Karmakar, learned APP submits that the Petitioner Respondent No.2 having settled the matter, no purpose would be served in continuing the criminal proceedings. He submits that based on the statements made by the Respondent No.2 in her affidavit ("X") the impugned FIR and the Charge sheet be quashed.

In view of the above, the Writ Petition is allowed in terms of the prayer clause (a). Consequently, the impugned FIR bearing No. 168 of 2023 registered with Tilak Nagar Police Station, Mumbai and the Charge-sheet bearing Case No. 1799/PW/2023 pending before the Metropolitan Magistrate, 34th Court, Vikhroli, Mumbai are quashed. Criminal proceedings arising out the FIR No. 168 of 2023 are closed. 7.

No orders as to costs..
