IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL REVISION APPLICATION NO.334 OF 2025 Umakant Basawraj Masali ...Applicant

Versus

Surekha Umakant Masali & Ors.

...Respondents

Mr. Milind R. Deshpande, for the Applicant.

Ms. P. P. Bhosale, APP, for the Respondent No.11-State.

CORAM:

MADHAV J. JAMDAR, J.

DATED :

7th AUGUST 2025 PC:- 1.

Heard Mr. Deshpande, learned Counsel appearing for the Applicant.

2.

The challenge in this Criminal Revision Application is to the order dated 24th July 2025 passed by the learned Judge, Family Court, Solapur below Applications bearing Exhibits-213, 214, 217, 218 and 219 in Criminal Miscellaneous Application No.14 of 2023. 3.

The learned Judge, Family Court, Solapur allowed the Application at Exhibit-213 filed by the present Applicant i.e. husband to produce the Complainant's Salary Certificate for the

period of January-2024 to June 2025. However, Applications bearing Exhibits 214, 217, 218 and 219 are rejected. The learned Judge, Family Court, Solapur has given the following reasons in paragraph No.6:

"6) The respondent's other applications at Exhibits 214, 217, 218, and 219 seek to summon witnesses and documents from various authorities and individuals to obtain information regarding Viresh Basavaraj Wale. However, there are no pleadings whatsoever to establish how Viresh Basavaraj Wale is connected to the present dispute. Such requests are irrelevant and clearly intended to delay the proceedings, contrary to the directives of the Hon'ble High Court. Accordingly, these applications lack merit and deserve to be rejected."

(Emphasis added) Thus, the learned Judge, Family Court, Solapur has held that the said Applications have been filed to summon witnesses and documents from various authorities and individuals to obtain information regarding Viresh Basawraj Wale. It has been further observed that there are no pleadings whatsoever to establish how Viresh Basawraj Wale is connected to the present dispute. It has been further observed that the Applications are filed to delay the proceedings.

4.

Mr. Deshpande, learned Counsel appearing for the Applicant failed to point out any pleading showing that any allegations are made regarding said Viresh Basawraj Wale.

5.

Mr. Deshpande, learned Counsel further submitted that the directions of High Court referred in paragraph No.6 of the impugned order are not concerning said Criminal Miscellaneous Application No.14 of 2023 but are concerning Divorce Petition. However, the said contention is not concerning the merits. In any case, what is observed by the learned Court is that applications are filed to delay the proceeding.

6.

Thus, the impugned order has been passed by taking into consideration the relevant aspects. Therefore, no ground is made out for interference in the impugned order.

7.

Accordingly, the Criminal Revision Application is dismissed, however, with no order as to costs.
