This is an application for suspension of sentence imposed by the J.M.F.C., 'F'

Court, Mapusa in Criminal Case No.OA/505/2018/F. The Applicant was convicted of an offence under Section 138 of the Negotiable Instruments Act and was sentenced to undergo imprisonment of 7 days and to pay compensation of Rs.1,70,000/- and in default, to undergo 15 days imprisonment. The order of conviction was challenged before the Sessions Court in CRIA No.155/2023 before the Sessions Court, Panaji. The learned Advocate submits that during the course of the hearing of the appeal, 20% of the compensation amount came to be deposited before the Sessions Court.

The Applicant submits that he is willing to deposit an amount of Rs.30,000/- immediately before this Court towards the compensation amount. The Applicant is directed to deposit this amount before the Registry within four weeks from today. 3.

In the meantime, the sentence of the Applicant shall stand suspended on the Applicant executing a PR Bond of an amount of Rs.10,000/- before the Superintendent, Central Jail, Colvale, and on his release, execute a PR Bond of Rs.10,000/- and one surety in the like amount before the J.M.F.C., Mapusa within a week therefrom. The Superintendent, Central Jail, shall remit the PR Bond executed before him to the concerned Magistrate.
