2. Placing reliance on the judgments of the Division Bench of this Court namely Mr Siddiqui @ Suleman Khan V/s. The Investigating Officer & Ors. - Criminal Revision Application No.683/2025(F) (delivered on 27.11.2025) and Vitthal Mahadeo Shelar V/s. The State of Maharashtra and Anr. - Writ Petition No.5256 of 2025 (delivered on 17.12.2025), he would submit that the Applicant in this case was not communicated the grounds of arrest as contemplated by law.

3. Mr Karpe, learned Additional Public Prosecutor, tenders on record a reply affirmed by the Investigating Officer, wherein it is stated that 6th February, 2026

CRMAB 43 of 2025 the Accused/Applicant was informed of the grounds of his arrest at the time of his arrest. Mr Karpe seeks some time to file an additional affidavit of the Investigating Officer along with the necessary documents to make good his submissions that the grounds of arrest were informed to the Accused/Applicant at the time of his arrest.

4. To enable him to file such an additional affidavit, list the matter on 16.02.2026.
