Heard learned Senior Advocate Shri.Ponda for the Appellant and learned APP.

The arguing Counsel Shri.Rajput for the Respondent No2 / First-Informant appeared virtually. He is desirous to attend the Court physically in the afternoon session.

In the charge-sheet against the Appellant, Sections of Indian Penal Code, 1860 ("IPC") are invoked so also the provisions of Satish Sangar 1/2

3-APEAL-245-2025.doc Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 ("SC & ST"). According to Mr.Ponda, his client belongs to Vimukt Jati and as such the provisions of SC & ST Act cannot be invoked against him. He places reliance on the Caste Certificate copy on Page No.406.

Learned APP seeks time to verify this fact. They are supposed to address the Court on the next date on this aspect. It is made clear that the Court will not adjourn the matter for verifying this fact. So far as the IPC offences are concerned, Court will hear both the sides on the basis of materials submitted along with the charge-sheet. 5.
