By this appeal filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Appellant-State seeks cancellation of anticipatory bail granted to the Respondents. 2.
The informant lodged First Information Report (FIR) against the respondents alleging that they have committed an offence punishable under Sections 354(A), 506 r/w Section 34 of the Indian Penal Code (IPC) and Sections 3(1)(r), 3(1)(s), 3(1)(w)(i)(ii), 3(2) (va) of the Scheduled Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989.

Perusal of the impugned order passed by the Sessions Court shows that the supplementary statement of the informant was recorded after five months of the incident. No specific words regarding her caste were mentioned by the informant. Considering the facts and after perusing the investigation papers, the Sessions Court has rightly exercised discretion in favour of the respondents. 5.
In the present matter, charge-sheet is filed on 28.03.2025 and the case is numbered as Special Case No.70 of 2025. 6.
In view of above and as there is no illegality and perversity in the order passed by the Sessions Court, application being devoid of merits and is dismissed.
