10.APEAL.489.2025.ODT 1.

Mr. Gawai, Learned A.P.P. submits that the Affidavit has been filed on record to indicate that during the relevant period i.e. November, 2020 malls were partially open with condition of 50% capacity. He relies upon Circular / Order issued to that effect dated 24th February, 2021. The said Circular / Order indicates that the activities will be permitted outside the containment zones. 2.

There is nothing in the affidavit to indicate that the mall in question was open during the relevant period so also it was outside the containment zone.

Mr. Gawai, Learned A.P.P., therefore, seeks further time to file Affidavit clarifying the afore-stated aspects. 4.

At his request, stand over to 2nd February, 2026. 5.

Interim relief, granted earlier, to continue till the next date. (R. M. JOSHI, J.) { 17th January, 2026.
