Heard learned counsel for the Appellant and learned APP.

The learned counsel for the Appellant submit that, initially offences under relevant sections of the Indian Penal Code were registered against the Appellant and this Court (Coram : Rajesh Patil, J.) has granted interim protection to the Appellant. Thereafter, sections of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 ('SCST Act' for short) added against the Appellant. Hence, the Appellant had filed N.S. fresh anticipatory bail application before the learned Special Court but it was rejected. Hence, requested to allow the Appeal. 3.
The learned counsel further submitted that, as earlier interim protection was granted to the Applicant, this fact to be considered and dispute is about a transaction of the land. 4.
The learned APP strongly objected to allow the Application and seeks time to take instructions. 5.
I have heard both learned counsel.

It appears that, initially FIR was lodged under relevant Section's of IPC against the Appellant. Thereafter, sections under SCST Act are added against him. The Appellant had preferred fresh Application for anticipatory bail, which is rejected and the present Appeal is filed against it, as the Appellant was already protected under Section of the IPC and in FIR there is no mention about abuse on caste. Considering these facts, I pass following order.
ORDER
(i) In the event of his arrest in connection with investigation of C.R.No.0316 of 2024 N.S. Kamble page 2 of 3
Sarkarwada Police Station, Nashik, the Appellant shall be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount.
(ii) Issue notice to the Respondents, returnable on 19th June 2025.
