***** CORAM :

S. M. MODAK, J.

DATE :

08th SEPTEMBER 2025 P. C. :- 1.

Heard learned Advocate for the Appellants, learned Advocate for the first informant, and learned APP.

2.

The provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 were invoked at the subsequent stage. At an earlier stage, these Appellants-accused were protected from arrest by this Court. They were asked to co-operate with the Police. The issue is about execution of the documents in question by the first informant. He denies the execution. The issue is who has executed the documents in place of the first informant. The Police have sent the documents to State handwriting expert and report is awaited. The first informant has obtained opinion by private experts. It supports his contention. Yet the report of the State expert is necessary. 3.

The second issue is about applicability of the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. The Appellants contend that they belong to Scheduled 2/3

Tribes community. They have handed over respective certificates to the Police. The Police wants to verify them.

4.

Stand over to 30th September 2025.

5.

Ad-interim order granted earlier, if any, to continue till the next date.
