Ms. Madhavi Mhatre, learned APP for the State, at the outset raises an objection to the tenability of the present bail Application. She submits that the offences charged in the subject crime include offences under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 ("the Act" for short). She submits that all orders passed in respect of the provisions under the Act, would be appealable in Section 14(A) of the Act. 2.

Mr. Sumeet Upadhayay, learned Advocate for the Applicant agrees to the said contention of the learned APP and states that indeed an appeal under Section 14(A) of the Act, would be maintainable against the order dated 28.05.2024 rejecting the bail application of the Applicant. He states that the Applicant is in

13-ba-2356-2025.doc custody and therefore, leave be granted to convert the present Bail Application to an Appeal under Section 14(A) of the Act. 3.

As the Applicant is in custody, leave as prayed for to convert the present bail application to an appeal under Section 14(A) of the Act, is granted.

Applicant to carry out the necessary amendment in the memo of the application.

Registry is thereafter directed to convert the bail application to an appeal, under the relevant provisions. Applicant to comply with any objections that may be raised by the Registry. (ASHWIN D. BHOBE. J.)
