DATE : 11th SEPTEMBER 2025 P.C.:- ON 10 th SEPTEMBER 2025 :- 1) Learned Advocate for the Appellant has circulated the Appeal for modification in the dates of release of Appellant on temporary Bail. 2) Mr. Desai, learned senior counsel for the Appellant submitted that, Order dated 26th August 2025 was uploaded on the official website of the Bombay High Court on 4th September 2025. That, from 5th September 2025 to 8th September 2025, there were Court and State Government holidays. However on 8th September 2025, the Appellant has deposited the cash security amount of Rs.25,000/- with the Superintendent of Taloja Central Prison. He submitted that, for his release from jail, the Jail Authority directed the Appellant to bring Release Warrant from the trial Court. As the Appellant 1/3
could not comply with the said direction, he was not released on temporary bail on 9th September 2025, by the Superintendent of Taloja Central Prison. 2.1) We are astonished to hear the said submission. It was our specific direction to release the Appellant on temporary bail on or before 9.00 a.m. of 9th September 2025 till 6.00 p.m. of 11th September 2025 and due to demand of the said Release Warrant by the Jail Authority, our Order is frustrated. 3) At this stage, Smt. Deshmukh, learned in-charge P.P. submitted that, the Superintendent of Taloja Central Prison will file its Affidavit, tendering apology for non-compliance of the Order. 4) At her request, stand over to 11th September 2025. TODAY i.e.
ON 11 th SEPTEMBER 2025 :- 1) In view of the deliberation in the Court yesterday, Shri Pramod Wagh, Superintendent of Taloja Central Prison has filed his Affidavit dated 11th September 2025. The concerned Authority has tendered its unconditional apology for not complying with Order dated 26th August 2025. In paragraph No.5 it is stated that, on 10th September 2025, at about 11:00 p.m., the Appellant has been released from Taloja Central Prison. 2) In view thereof, duration/period of temporary bail of the Appellant in pursuance of Order dated 26th August 2025 is modified and the Appellant is granted temporary bail from 11:00 p.m. of 10th September 2025 till 6:00 p.m. of 13th September 2025 (both days included). 3) Order dated 26th August 2025 is accordingly modified.
4) Praecipe dated 10th September 2025 is disposed off. 5) All the concerned to act on the basis of an authenticated copy of this Order.
