P.C.:- 1) By this Appeal under Section 21(4) of the NIA Act, the Appellant has impugned Order dated 22nd April, 2025, passed below Exh496 in Special Case No.723 of 2024 by the learned Special Judge under NIA Act and UAPA for the Greater Mumbai.
2) By the impugned Order, the trial Court has rejected the Application of the Appellant seeking modification of bail condition imposed upon her.
3) By an Order dated 10th May, 2016 passed below Exh-203 in Sessions Case No.655 of 2011 (now Special Case No.723 of 2024), while 1/3
releasing the Appellant on bail, the trial Court, apart from other conditions, has imposed the following condition.

(b) The applicant/accused shall attend Wani Police Station, Taluka Wani, District Yavatmal, on every Saturday in between 11.00 to 11.30 a.m. and on every 2nd date of each month to Sr. Police Inspector, ATS, Akola Unit, in between 11.00 a.m. to 11.30 a.m., till final disposal of the case."
4) Mr. Arote, learned Advocate for the Appellant submitted that, the Appellant is regularly complying with both the conditions. He submitted that, now the Appellant is settled at Nagpur. That, she is regularly complying with the condition of attending the office of ACP, ATS Nagpur Unit and therefore the second condition i.e. to attend Wani Police Station, Taluka Wani, District Yavatmal on every Saturday between 11.00 to 11.30 a.m. be waived or relaxed.
5) Learned APP on instructions from API Mr. Shedage, ATS Thane Unit fairly conceded the fact that, the Appellant in pursuance of Orders passed by the trial Court is regularly attending the office of ACP, ATS at Nagpur.

6) In view of the above, the condition to attend Wani Police Station, Taluka Wani, District Yavatmal on every Saturday between 11.00 to 11.30 a.m. by Order dated 10th May, 2016 passed below Exh-203 in Sessions Case No.655 of 2011 (now Special Case No.723 of 2024) is waived and the Appellant is directed to continue to comply with the directions of attending the office of ACP, ATS Nagpur Unit as per Order dated 8th January, 2018.
7) In view of the above, the impugned Order dated 22nd April, 2025 is set aside and the Orders dated 10th May, 2016 and 8th January, 2018 are modified to the above extent.
8) Appeal is allowed in the aforesaid terms.
