The Appellant has filed this appeal for relaxation of condition imposed while granting bail. The Appellant is released on bail by the Hon'ble Apex Court and the Sessions Court has imposed the condition not to enter Mohol taluka. This Court has relaxed the condition on 14th November 2025 for limited period of 15 days as his wife has delivered a baby Now the Appellant has stated that he is the only person, who is taking care of his wife and child. The trial is at the fag end. The condition is relaxed by this Court (Coram : Shivkumar Dige, J.) vide order dated 19th December 2025 imposed Gaikwad RD 1/2
14-apeal-1000-2025.doc on other co-accused-Santosh Janardhan Surwase. One of the accused is released by this court and no such condition was imposed while granting bail. The Appellant will not create any problem if the condition is relaxed. Hence, prayed to release the condition. 2.
The learned APP opposed the application stating that this is election period. There is possibility of creating any problem. There are three criminal antecedents against this Appellant. 3.
In all six witnesses are examined. As the trial is initiated and for 15 days he has not created any problem. The condition imposed on him is modified, but the Appellant shall not enter the area where the witnesses and deceased are residing.

The Appeal is accordingly disposed of.
