Heard learned Advocate for the Appellants and learned APP. The FIR is in respect of the certain caste abuses given to the first informant - Manoj. He is a relative of one Shefali. Said Shefali is married to Accused No.1-Mahendra. Mahendra is arrested and granted regular bail. Appellant No.1-Manoj is his real brother whereas other two Appellants are his distant relatives. Primarily the FIR is in respect of two incidents (i) in the month of March 2023 Digitally signed by LATA SUNIL PANJWANI Date:
2025.10.18 18:34:01 +0530 LATA SUNIL PANJWANI and (ii) on 3rd April 2025. There are caste abuses on these two instances. There are other minor incidents too. 2.
There are matrimonial proceedings going on in between Accused No.1 & said Shefali. After going through FIR it seems that
LSP 2 501 apeal 1044.25.doc there is no specific allegation of caste abuses by Appellant No.1Manoj. He needs to be granted interim protection. So far as Appellant Nos.2 and 3, notice is to be issued to Respondent No.2. Hence, the following order:
ORDER
(i) Issue notice to Respondent No.2, returnable on 20th November 2025.
(ii) Till next date, in case of arrest, the Appellant No.1-Manoj Anil Kawade be released on bail in connection with C.R. No.247/2025 registered with Mundhwa Police Station on furnishing Personal Bond and Surety Bond of Rs.20,000/-. (iii) He is directed to co-operate the police as and when required.
(iv) He is directed not to threaten the prosecution witnesses or allure or contact them in any manner. If there is breach of any of the conditions, his anticipatory bail is liable to be cancelled subject to notice.
