Learned counsel for the appellant submits that here in this case, there is also chargesheet filed and during the course of the investigation, notice was issued to the appellant under Section 41 of Cr.P.C. It is his submission that there is delay in lodging FIR of four days and owing to the fact that there are disputes between the parties, the possibility for false implication is not completely ruled out. It is his further submission that since the chargesheet has already filed there would not be any impediment in protecting the liberty to the appellant till the application is heard. 4.

From prima facie perusal of the record this Court finds substance in the contention of learned counsel for the appellant. In order 1/2
