Learned counsel for the appellant submits that in the First Information Report there is no allegation against the present appellant with regard to to any appeal being heard against the informant over his caste and thereby insulting him. It is his submission that in view of the said fact no offence under Section Atrocities Act is made against the appellant. He claims that appellants have not criminal history behind them. 3.

Having regard to the afore-stated facts and prima facie perusal of the First Information Report, this Court finds apparent substance in the contention of learned counsel for the appellant in order to protect the liberty of the appellant, till the respondent No.2 is heard in the matter. 1/2

In view of above, there shall be ad-interim relief in terms of prayer clauses (b) and (c).
