After arguments are concluded, learned counsel for the respondent No.2 and learned APP makes statement that the charge is likely to be framed on the next date of hearing before the Trial Court i.e. on 06.01.2026.

Learned counsel for the appellant opposes the said submission by stating that though chargesheet has been filed in the year 2024 since then no charge is framed. In response thereto, it is submitted by learned APP that since Court is vacant for three months and hence charge is not framed. However, it is expected that charge will be framed on the next date of hearing.

Having regard to the nature of offence, this Court finds it appropriate to give reasonable time to the prosecution. It is however clarified that if no charge gets framed on the next date of hearing present application shall be decided on merit.
