It appears that the reason why petitioner is before us is the failure of learned Judicial Magistrate First Class, Court No. 6, Nagpur to decide the application viz. Cri. Misc. Application No. 3600/2024 filed by the petitioner under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (old 156(3) of Criminal Procedure Code, 1973).

Before we issue notice, it will be appropriate to seek report from the learned Magistrate as to the status of the application. Order accordingly. The report shall be filed by 24-2-2026. Registry to do the needful. List on 25-2-2026.
