Learned Counsel for the petitioner placed reliance on the decision of Yuvraj Sitaram Dhamale vs State Of Maharashtra and another reported in (2024) 1 High Court Cases (Bom) 634, wherein it is held that in discharge application the original complainant is a necessary party and therefore, he seeks liberty to add the informant as a party.

Liberty is granted to the petitioner to add informant as a party. On adding informant as a party, notice be issued to the informant returnable after two weeks.

Petitioner is permitted to carry out the amendment forthwith.
