The petitioner, who suffers allegation under the provisions of Indian Penal Code / MPID Act, is one of the Directors of the Company named and styled as 'IX Global Company". The said Company is allegedly involved in the business of creating or offering the platform of education in respect of Forex Trading, Crypto Trading, etc. It is a multi-level marketing company.

It appears that various persons have invested amount on the basis of assurance given by the Company of handsome returns through various persons at various levels. The promise remained on paper and not materialized. The end result is, some of the investors approached the Police and lodged report. Investigation in couple of FIRs is completed, one was registered at Nagpur and another was at Mumbai. Accordingly, charge sheets

2 20-CRI-WP-337-2025.odt have been filed before the MPID Court at Nagpur and MPID Court at Mumbai. The investigation in three other crimes is still pending.

Along with directors, the agents and executives engaged at different levels of marketing skills are also made accused. The petitioner seeks to transfer the trial to one Court. As such, his request finds support of the Judgment of Division Bench of this Court at Principal Seat in the case of Pramod Bhaichand Raisoni and others Vrs. The State of Maharashtra and another in Writ Petition No.2784/2018, we, however deem it appropriate to hear other accused before taking a final call.

The petitioner shall accordingly add, as respondents accused in the charge sheets filed before the Court at Nagpur and Mumbai.

Necessary amendment shall be carried within seven working days from today.

Once the amendment is carried, issue notice to the newly added respondents, returnable three weeks thereafter.

In addition to usual mode of service, the petitioner shall serve the newly added respondents by all permissible modes, including service by Speed Post and shall file an affidavit of service.

In addition to above, we direct the Investigating Officer concerned to inform of this development to the newly added respondents.
