It is not in dispute that the petitioner was already released on furlough on earlier two occasions from the open prison on furnishing a PR Bond.

In that view of the matter, the objection raised by the respondent that the new set of Rules notified on 02/12/2024 overrules the earlier regime viz. the release of the prisoner lodged in the open prison on PR Bond, cannot be accepted particularly when the issue is under consideration of the State Government.

That being so, we direct release of the petitioner on PR Bond. 5.
