Heard learned counsel for the petitioner.

In this petition, the order passed by the learned Judicial Magistrate, First, Court No.8, Amravati dated 29.11.2023 granting maintenance at Rs.20,000/- per month to the respondent is under challenge. The petition also challenges the order passed by the learned Sessions Judge, whereby the appeal filed against said order came to be dismissed.

The contention is that the respondent/wife is serving as a Lecturer and earning salary of Rs.40,000/- per month whereas the petitioner/husband is earning Rs.45,000/- per month, having two dependents. It is informed that the respondent/wife is residing at the first floor of the house of the petitioner's father and even electric bills are being paid by the father of the petitioner. 4.

Issue notice to the respondent, returnable within four weeks.

There shall be stay to the impugned order dated 29.11.2023 passed by the learned Judicial Magistrate, First Class, Court No.8, Amravati, in PWDVA Case No. 228/2022, subject to the petitioner clearing all the arrears @ Rs.15,000/- per month, within six weeks and continue to pay interim maintenance @ Rs.15,000/- per month.
