By this Petition, the Petitioner has challenged the order dated 25.03.2025 passed by the District Judge-1 and Addl. Sessions Judge Gondia in Cri.Apl.No. 13/2025 rejecting the application for seeking permission to travel abroad. 2.

The Petitioner/Applicant by name Deepak Kunjilal Bhutada is facing prosecution which is still in progress and charge-sheet is yet to be filed. The Petitioner seeks permission to travel abroad contending that his son and daughter-in-law are residing in Texas (USA) since 2019. Now, the Petitioner alongwith his wife intends to visit at the house of his son on 25.03.2025 as his daughter in law has delivered a child and intends to stay there for three months. The said application was rejected by the learned District Judge-1 and Addl. Sessions Judge, Gondia by assailing the reason that the Applicant has not provided his travel plan or itinerary to demonstrate his travel plan i.e. the only reason, the application is rejected.

The learned Trial Court can consider the application if it is filed afresh by giving the said details with this direction the Writ Petition can be disposed of. In view of that, I proceed to pass the following order:

O R D E R

i.

The Petitioner shall file afresh application by giving all the details as to his travel plan. By giving details regarding the address of his son who is residing in Texas (USA) alongwith his Mobile number which he intends to use in Texas (USA) as well as the Mobile number of his son and daughter-in-law. In support of his contention, he shall also furnish the address proof before the District and Sessions Judge where his son is residing and details as to his itinerary.

ii.

The learned Trial Court shall consider his application on following all the details.

iii.

The learned Trial Court shall dispose of the Application within two weeks.

iv.

With these directions, the Writ Petition is disposed of.

Pending application/s, if any, shall stand disposed of accordingly.
