On previous date, the following order was passed :
"On 13th August, 2025, following order was passed: "Leave to amend the prayer clause by replacing the word "reinvestigation" by "further investigation" is granted. Amendment be carried out forthwith. 2. The First Information Report was lodged in the month of March, 2018. The charge-sheet has been not filed till today. The counsel for petitioner submits that the investigation has been stopped for no good reason. 3. For the time being, issue notice to respondent Nos.1 and 2 returnable on 02/09/2025.
4. Learned A.P.P. waives for respondent Nos.1 and 2." 2.
The learned A.P.P., on instructions, submits that the investigation is complete and A summary filed on 08/08/2018. The summary has been accepted by the trial Court.

3. In view of above, the counsel for the petitioner shall take instructions and make submissions about the maintainability of the petition.
4. Stand over to 9th September, 2025."

The counsel for the petitioner submits that, he will have to verify whether the "A" Summary is accepted. At this stage, learned APP submits that to the best of her knowledge "A" Summary is accepted. However, she has taken instructions from the concerned Police Station to find that there is no certainty as regards acceptance of "A" Summary.

In view of above, the counsel for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to approach the Trial Court to file protest petition against "A" Summary, if the same is not accepted and/or to challenge the acceptance in accordance with law. Permission granted.

Petition is accordingly disposed of as withdrawn with liberty as prayed for.
