The petitioner-mother seeks writ of habeas corpus on the allegation that respondent no.2-father has taken into custody her daughter, which according to her amounts to illegal detention.

The learned Counsel for the petitioner shall go through the judgment of Hon'ble Supreme Court in case of Nirmala .vrs. Kulwant Singh and others (Criminal Appeal 2194/2022), particularly Rgd.

Order 1408wp595.25 paragraph nos. 12, 13 and 16 therein and make submissions on next date.

Respondent Nos.2 to 4 are not served.

The petitioner is granted permission to serve them by speed post, in addition to regular mode of service, and file affidavit of service. Notice to respondent nos. 2 to 4 is made returnable on 03.09.2025.
