The petitioner/club is seeking relief to prohibit the police authorities from visiting the club, which, according to the petitioner, is being done every day, and further to prohibit them from taking action against the petitioner.

We find such a prayer to be strange, in the sense, the relief, as sought, is of the nature that police should be prohibited from taking action, which runs contrary to the duties of the police to take action in appropriate case.

As such, we are of the view that the petitioner should file a suit seeking injunction, however, counsel for petitioner submits that police is visiting with a view to harass the petitioner.

In the circumstances, we would like to test bonafide of the petitioner/club.

Issue notice to respondents, returnable in two weeks.
