Heard the learned counsel for the petitioner. 2.

The petitioner is challenging the order dated 27.10.2025 passed by the learned Civil Judge Junior Division, Ashti, District Wardha, wherein the application filed by the wife for attachment of salary was allowed in PWDVA Execution Case No. 5/2024 and it was directed to attach the salary of petitioner of Rs.35,000/- per month till the recovery of arrears of maintenance amount of Rs. 5,25,000/-.

The learned counsel for the petitioner submits that admittedly, the petitioner is in arrears, however the net salary of the petitioner is Rs.51,000/-. He further submits that though the petitioner is working as Lecturer and he is getting more Rs.1,00,000/- as a salary, there are other deductions from his salary. The learned counsel for the petitioner submits that to show his bonafide, he is ready to deposit Rs.2,00,000/- and he is not having any objection, if Rs.20,000/- per month is deducted from his salary.

Considering that the petitioner bonafidely is ready to deposit Rs.2,00,000/-, I am inclined to issue notice to the respondent.

Issue notice to the respondent returnable on 24.12.2025. The notice be issued to the respondent subject to deposit of Rs.2,00,000/- within four weeks in this Court.

In the meantime, the order dated 27.10.2025 passed by the learned Civil Judge Junior Division, Ashti, District Wardha is stayed till next date.
