It appears that the petitioner has filed an application before the Trial Court under Section 497 read with Section 503 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for releasing his vehicle i.e. Mercedez Benz GLA 200 CDI bearing registration No.MH-43AR-7399. Said vehicle was purchased by the present petitioner from one Yogita Santosh Sutar in the year 2021. However, till date the said vehicle was not transferred in the name of present petitioner and therefore, the Additional Sessions Judge, Nagpur has rejected the application of the petitioner at Exhibit 45, holding that accused no.2 i.e. present petitioner is not the registered owner of the car.

Learned Counsel appearing for the petitioner submits that he will get the said car transfer in his name and thereafter, he will again apply to the concerned Court. He further submits that permission may be granted to withdraw the present petition with liberty to apply afresh.

The writ petition is disposed of as withdrawn

2 14.cri.wp.1039.2025 with liberty to the petitioner to apply afresh after the transfer of the said vehicle in his name.

Needless to mention that in case the petitioner applies to the RTO for transfer of the said vehicle, wherever the vehicle is lying, the concern Registering Officer shall went to the said place and verify the said vehicle.
