DATED : 23rd December, 2025 The petitioner's son and nephew died in an accident that occurred on 22/05/2024. FIR to that effect was lodged on 23/05/2024 with Police Station, Hiwarkhed, Dist. Buldhana vide Crime No.130/2024. The petitioner is desirous of knowing the cause of death.

We are of the prima facie view that respondent No.3 has failed to discharge his duty in the sense, he should have completed investigation and disclosed the truth to the petitioner. In a given case, petitioner's son might have suffered accidental death, but the other possibility is of homicial death which can only be discovered in investigation. The FIR is filed in the month of May 2024. The investigation is not yet completed.

In this regard, the petitioner's counsel has invited our attention to the communication made by Deputy Superintendent of Police (Home), Buldhana informing petitioner's wife to not proceed for hungar strike which was set forth for failure of respondents to disclose the cause of death of

The Superintendent of Police, Buldhana has specifically requested the petitioner's wife to not proceed for hunger strike by giving assurance that development in investigation will be apprised to her from time to time. The commitment is, however, not honoured.

Issue notice to the respondents, returnable after vacation.
