Applicants seek enlargement on regular bail on account of their arrest in Crime No.106 of 2024 registered at Dindrud Police Station, District Beed for offence punishable under section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

It is pointed out that, applicants are arrested in above crime on 31.05.2024 and as such they are behind bars since almost a year. That, charge sheet is already filed on 26.08.2024. That, similarly situated persons, with similar allegations, are granted bail. That, copy of order passed by this court in Bail Application No.2192 of 2024 is placed on record. Therefore, on the ground parity, learned counsel urges for grant of bail. 3.
Learned APP opposed on the ground that, there are allegations of being in possession of 60 kg and some gram of ganja. That, raid was successfully conducted. However, learned APP fairly admitted that submissions made by learned counsel for applicants that similarly situated persons are granted bail. 4.
Heard. Perused the papers. FIR dated 31.05.2024 is by police official, who has reported that, on secret information, after constituting raiding party, raid was conducted near Yashwant Hotel. Car of which information was received was spotted and intercepted, which was occupied by four persons. On inquiry their names were noted and in the dicky of the car 30 packets of ganja like material was found and it was seized. Therefore, such persons were apprehended and crime is registered against those persons.

This court had granted bail to co-accused Datta and Kailash, who are shown as accused nos.1 and 3. Present applicant is shown as accused nos.2 and 4. Investigation is over and charge sheet is already filed. All formalities of drawing sample, dispatching the same and drawing inventory are shown to be completed. When no further purpose is shown to be achieved by further detention coupled with ground of parity, present applicants are also deserve similar relief. Hence, the following order is passed:
ORDER
I.
The application is allowed.
II.
Applicants, namely (i) Vijay S/o. Sunil Pawar and (ii) Vikas Anil Gadgil be released on bail in connection with Crime No.106 of 2024 registered with Dindrud Police Station, District Beed, on executing Personal Bond of Rs. 15,000/- each with one surety in the like amount each, on the following conditions: [a] Applicant shall not tamper prosecution evidence. [b] Applicants shall not leave the area of jurisdiction of the concerned police station till conclusion of trial. [c] Applicants shall regularly attend each and every effective date before the trial court.
